The announcement that Globespan Group has gone into administration is bad news and will come as a shock for thousands of customers of low cost airline FlyGlobespan who were looking forward to winter sunshine or a visit to family and friends this Christmas.

Booked a package holiday

This information is available on the FlyGlobeSpan website but to confirm, consumers who have booked a package holiday with The Globespan Group plc are probably going to be protected under ATOL, so you need to visit the Civil Aviation Authority website for further information.

The Civil Aviation Authority (CAA) has published information for consumers affected.

Booked flight-only

The GlobeSpan website states that consumers who have booked a flight through Flyglobespan are unlikely to be covered by the ATOL scheme. You should be able to claim through your credit card company under section 75 of the Consumer Credit Act 1974..

Those unfortunate to be stranded abroad and have booked the flight direct with FlyGlobespan will have to make arrangements to return home. Check your travel insurance policy document to see if it includes airline failure insurance.

Travel Trade Gazette was the first to break this story, and we’ll be following it with interest. Let’s hope customers who used credit cards will be dealt with fairly. The XL collapse led to a lot of arguments with the banks. But again, those who bought package holidays with an agent should be fine…

dear sir, I has booked a holiday with flyglobespan for the 24th feb to the 3rd of march 2010 in benidorm flying from glasgow and probooked our seats aswell and the insurance aswell.
what information could you gave me I paid the holiday with my credit card.
also what are the chances of me and my husband still getting the holiday, if not how do I start to get my money back. please help me thank you

Hi Nancy,

Is it a package holiday, all parts of the holiday booked with them or did you book the flight with them and the accommodation with another company?

If you booked a package holiday (you probably will have only receive one invoice/paperwork) then you will get the money back via ATOL protection through the CAA. If you booked a flight-only with them, and accommodation elsewhere then you should be able to claim through your credit card.

Let me know which one and I will try and guide you in the right direction.

Hi,

My friend had a booking for flights only and she paid this with a Visa debit card. Now having spoken to her bank has been informed that she is not under any protection as mentioned on the flyglobespan website?

Can you give me any advise please that I can pass onto her as she is in Cyprus and was supposed 2 be flying home for xmas?

I was booked up with globespan for a 1 weeks stay in Benalmadena (Malaga) with my husband. Leaving on 26th December from Edinburgh and returning on 2nd January 2010.

We have booked flight only with our accommodation booked elswhere. My husband booked these flights with his credit card and after todays events, I have booked another 2 flights with Ryanair. My husband telephoned his credit company tonight and was told to go to Glopespan for a claim form. I dont think this is the correct advice as the credit card company should be the one issuing the claim form.

Where do we go from here?

Sorry for those who are stranded.. at least we dont have that problem. Hope you all get home safely.

Hi, the Maestro card is a debit card (I have one too) and unfortunately I do not think you will not be protected through the Consumer Credit Act 1974.. It’s unlikely, but, I do know a few people that contacted their bank and had success recieving a refund when other travel companies have gone into administration in the past.

She should be able to claim with a Visa debit card, it is known as Visa Chargeback. I would get to ask her bank again. If the person she is speaking to does not know about the chargeback then ask for a manager or supervisor. She must do the chargeback within 120 days of the company going into administration.

Let me know how she gets on.

I do know people have claimed back successfully with a visa debit card.

I would go back to the credit card company again and tell them that you want a claim form to claim back your money due to the administration of the company. Tell them that you are claiming under section 75 of the Consumer Credit Act 1974..

Speak to someone senior if you do not get a satisfactory response.

If its a visa credit card then yes you’ll be covered under section 75. If its the debit card then it’ll be under the Visa chargeback scheme. Contact your credit card company and they should send you out a claim form.

Contact the travel agent ASAP, bear with them though, they could have a few people in your position that they have to deal with. What travel agent did you book through? Some have posted instructions already.

@ Simon

Well if you have booked with a credit card that’s a good sign. It’ll mean you’ll get your money refunded if it is just a flight you have booked with them. If its a package holiday then you’ll have to claim via CAA / ATOL, a link is in the post for more information.

As for flying tomorrow, sorry, you’ll not be able to fly as all services have been cancelled and the aircraft grounded. :(

Have booked through Lowcostholidays.com and the payment including the flyglobespan flights to Sharm el Sheik on the 26 Dec was made to them on my Mastercard . Who should I be looking to for compensation / refund. Lowcostholidays, mastercard or my holiday insurance.
Lastly should I book other flights if possible or just try and claim the full holiday, and rearrange another later.

Hi have booked hotel and flight seperatly through travel republic and paid full balance by credit card supposed to fly on sat 19th Dec for 2 weeks cant get anyone in travel republic they closed at 8 last night and did not answer their phones before that, must say it was Good of them !
cant get another flight even from London as prices have jumped so much where do we stand getting our money back as we really want a holiday and are prepared to go elsewhere but have to be sure we are covered before paying out again thanks janet & alan

Well it seems Lowcostholidays are ATOL members so if you booked through them then they would be my first point of contact. Remember that the news only came through around 5.30pm last night and they will be others in your position. They should be able to provide you with more information.

To be fair the news didn’t break until around 6pm last night and confirmation from FlyGlobespan didn’t appear on their page until 7pm ish. So, there’s not a great deal that they could have done last night.

If you have paid via credit card then you should be protected under section 75 of the consumer credit act. I know that Travel republic also have their own protection scheme so I would contact them aswell.

Bear with them though – they are nearly 5,000 people stranded abroad and many thousands who will be in the same position as you.

I have booked five flights only to lanzarote in June, paid via oneccount debit card (not visa) currently out of pocket by over £1.5k, I will contact my bank today after 8am and let you know how it goes, on the website for globespan it says that claims should be sent to the address given, is this for consideration for refund?

If you have used a “normal” debit card then the chances of refund though the bank is slim, but it certainly is worth contacting them to find out. Did you take out any travel insurance? If you did it might have included airline failure insurance.

Have a try contacting the administrators helpline (0871 271 9000) but get in early, it’ll be busy today. You might be able to claim via the administrators. Here is another site that explains your rights

All consumers affected please read the useful information below.

Travel Agent policy dealing with airline failures. We will deal with customers in the following order (or try to). Having experanced this it can take 30 minutes -3 hours to book a holiday. BUT 2-5 hours to sort a rescue or alternative flight.

1 Those strand abroad
2 Those travelling this week
3 Customers travelling in this month (next 4 weeks)
4 Customers by date of departure, closest first.

All travel agents will expect you to contact them. Please listen to what they say, but do not expect an instant answer . However each time someone rings this delays them from searching or arranging flights. For webcompany’s check there website. General advice if you not travelling in next 6 months do not contact your agent today. (Yes I know this is hard).

I have booked flights for July 2010. I called my credit card company this morning – Capital One – finally got them to send a claim for but they kept saying they cant promise anything although I stated clearly I was making a clain under Section 75…..
Doesnt help when speaking to an Indian call centre, language barrier to encounter.

Do you know timescales for this refund, are we talking months? thanks

I booked flights for Orlando for 2010, i had only paid the deposit (which was £611) all paid for by mastercard, i have already got in touch with bank and just need to put it all in writing, buti wanted to check will i be covered even though i hadn’t paid the full amount???

That information should be on any insurance policy documents. The insurance documents on their website seems to have disappeared but I did a quick Google search and found this document. I do not know how reliable or up to date it is, but it might help you

I am sorry it is one of those ‘how long is a piece of string’ questions. It depends on the bank or credit card company. I’ve seen it take anything form a few weeks to a few months. Keep a copy of any documentation and make sure you contact them regularly to get updates. If you have paid by credit card then you should be protected and receive the money back evenutally.

If you paid by credit card then you should be protected as its over £100 (I think thats the minimum amount your covered from) so put it in writing but I would also ask if they have a claim form to apply for the refund. Asking you to send a letter might be a delaying tactic, or the person you spoke to might not be aware of the process.

Darren, My experience claiming from LloydsTSB over LTE.

Sent letter
2 weeks later got reply and form to sign and send back with receipt or ticket.
1 week later amount shown on statement as disputed
4 weeks later another form
1 week later refund

Any amount over £100 in value is covered. Even Deposits. So if deposit is £50 but holiday is £200, the £50 is still covered.

my first choice over the years has been to fly with Globespan..i booked a holiday last week with tour operators, On The Beech Holidays, who clearly state the do not sell package holidays.but i did buy the flight,hotel and transfers from them at a good price.and it was a no frills flight and thought i would have had the pleasure of flying with Globespan again,but to my dissapointment at the time, it turned out i would be flying with Ryanair….CLOSE ONE..as i paid by debit card…i fly on the 10th of january 2010 and im going to purchase travel insurance from A.A. travel ,as they clearly state their policy covers for companies who go into administration..so think im ok now, just in case Ryanair sink as well…i also had the option of paying the holiday again by credit card ,paying the diffirence and getting my debit card payment refunded…i hope all the Globespan travellers and cabin crew get home safely..and every one who has still to go their holiday,get refunded and find another holiday……Stevie

Bought flights directly from flyglobespan with Debit card, no insurance

have went through every channel possible, the outcome is that i have to send a letter to the underwriters to make any claim, they are not obligated to refynd any cost, and consumers come very low on their payouts once they sel off the assets.(planes etc)

please remeber that when you call the globespan helpline, the people you talk too have just lost their jobs at this time of year.

Lesson learned, always use a credit card.

My hat is off to TravelRepublic though who agreed to refund my entire accommodation costs even though i booked the flights directly with GS…Thank you

Following is the position of AA Travel Insurance in respect of the British Airways strike threat and collapse of Scottish operator Flyglobespan. Customers of the latter may be covered for financial failure as this is included in all AA travel insurance policies issued since 4th July 2009.

From M&S Money

M&S Money is offering to refund in full foreign currency purchased from M&S by customers who have booked flights with Flyglobespan and are now unable to travel.

Customers can take their unused currency into any of the 122 M&S bureaux de change until close of business on Saturday 9th January 2010 and exchange it for the full amount of sterling that they paid for the currency.

It seems One Underwriting Limited and FirstAssist Insurance Services Limited are the two companies mentioned online. The document I linked to above is a cached copy from Google of what was on the airline’s website prior to it being taken down.

I’m a little confused who you need to contact so I will try and get someone to confirm.

Thanks Darren…for your travel feed back…ive was very fortunate this year and last year,as i was home for about 3 days from a holiday i booked with Seguro Holidays and they went bust along with L.T.E airlines..its good to have piece of mind when booking by credit card,but the charge on that can be saved when enqiries are made to an insurance company to make sure they cover for financial holiday failure,as not all them do cover..some will only cover the cost of a hotel and flight home…A.A insurance seems the best deal to me..£12 or £15 per person with baggage and money…no excess on holiday failure refund..i think Globespan will refund all the customers who paid by debit card…they will just have to wait that bit longer than credit card holders…i mean they are owed £30million….

Are payments via Mastercard (credit) treated the same way as payments via a Visa credit card? That is, a claim for a payment with a Mastercard can also be made via section 75 of the Consumer’s Credit Act of 1974?

Also, I read that people ‘should’ get their money back, but what does that mean exactly? That by law people will get their money back or is it at the discretion of the banks?

Another point is the amount being above £100. What does that exactly mean? In total? Or per person, per leg of travel? If a person paid £230 for flights for 2 people by Master card will the full amount get refunded or just the amount above £100?

I booked in August 2009 to fly to Malaga in Feb 2010 online

2 x Adults and 2 x Kids and 1 Infant
I booked a fly drive (flights + car hire)
I paid using my VISA Debit Card.
The booking confirmation has 2 line items -
APC-ATOL PROTECTION CONTRIBUTION 1.00 2 2.00
APC-ATOL PROTECTION CONTRIBUTION 1.00 2 2.00

Does this mean I am ATOL proetected and claim from them first?

I tried the my bank (BOS) for VISA DEBIT CHARGEBACK but they are deliberately fobbing me off and saying they are not part of any VISA DEBIT CHARGEBACK.

PLEASE HELP!

I mentioned yesterday, that paying buy credit card and the extra charge can be avoided if you get an insurance company who will insure you if a company goes into administration..only problem is…if you go on holiday for 7 days, then your only covered for those 7 days…therefore if you book the holiday 1 month in advance, and the company goes into adminisrtation..YOUR SNOOKERED…..I now learned credit card is the best option, as your covered months before…

The news is that E-clear owes flyglobespan £36 million, if you put this in to company terms. In 2008 flyglobspan lost 11million, in 2009 they made 1.9 million profits. E-clear owe £20 million to the airline for customers who have already flown. Remember most passengers pay this way. That for an airline of this size is months of operating monies tied up for no reason.

Flyglobespan t/o based on 9 aircraft (same size as when it went bust) in 2004 was 98 million. That year it had a 70% increase in profits! E-clear is already facing legal action by Skyeurope over failure to pass on monies.

We booked with low cost holidays to Sharm el Sheikh flying out 26 Dec.
Though we we went fro flight+holiday thinking a package deal it seems they have done seperate bookings. They sent in an email to all the customers on 15 Dec saying their was an error on their earlier documentation and that the booking is not ATOL protected.

After hours of trying to reach them today soemone told us that they have taken an insurance policy for all their customers – Something “Suuplier Failure Insurance/Cover” which should pay us. Only thing is we need to contact the insurance company directly, When called the insurance company we were informed this does not work. Also seems low cost holidays only took the insurance on 16th December 09. Not sure how this will work.

The sad part is though we used our LTSB VISA DEBIT Card, we are not sure if we will be covered under the visa umbrella scheme beacuse the payment was doen to low cost holidays and not Flyglobespan.
No idea waht sort of document will be required from lowcost holidays to prove goods not delivered..

Because of the unsurety on documents required do not knwo if we should pay more and ask lowcost holidays to change holidays or not . Afraid that if we change holidays we may not be able to get a proof of goods not delivered. They may get by saying that we requested a change in the original booking etc etc.

Any help and suggestions would be welcome.

Anyone who dealth with low cost holidays before with the XL disaster can may be guide us. As the lowcost hoilday people say that all last years customers were paid via their insurance. Anyone else in the same situation??

@kevin fawl…..i went to BOS yesterday and enquired about the refund situation regarding visa electron debit card….they told me if i was ever in a situation of a travel company going into administration,then it would not be guaranteed they would get my cash back..they said they would chase the company to see if they are going to pay up..i asked another teller at another branch and she said ,the difference between a debit and credit card is,that you will wait longer but will get refunded ….i fortunetly booked with Ryanair this time and was not affected,i also booked with debit card,

@Bree – low cost holidays hold an ATOL 6516. If they package your holiday flight+hotel, I too would think when booking it would be covered and they were the Tour Operator. Keep your original ATOL confirmation, if it says on this confirmation your booking arrangements are covered by their ATOL no. 6516, and then now change their minds and say that was an error, I’m not sure what they are up to. Speak to someone at the CAA for clarification or to ABTA who they are also member of. It sounds like they are not sure of their responsibility. I hope some one else can advise you

@Bree – Additional to my post last night – I can only image, low cost holidays booked your holiday arrangements the same way that Travel Republic do. The fact that you say low cost holidays booked ‘Supplier Failure Insurance/Cover Insurance’ on 16th December 09, is odd. Maybe this is why the ‘Supplier Failure’ is not covering you even if you booked before that date. The 16th is the date of the fail. Bad business policy all round if you ask me. I would go to ABTA for some ansers. ATOL are not going to cover you because of they way low cost booked your travel arrangements.

Hi, ive booked flights only (paid by debit card)through On the beach and was flying with globespan the remainder of the balance is due in a couple of days ,when i contacted On the beach they said it was still to be paid as they have posted a message on theyre website saying along the lines of they will try and get alternative flights cheaper or the same price if i dont pay am I breaking my contract with them?I also asked if i could change my flights to october and they said no.

We are currently residing in egypt and came home for xmas, our flight was the last flight into glasgow airport on the 16/12. We heard the news when we were travelling into ayr. We were booked to travel back to egypt on the 30/12 with train tickets booked for the 29/12 to glasgow from halifax and overnight stay in a hotel. We have managed to book alternative return flights with another airline from manchester at an extra cost of £350. We paid with a visa debit card and want to know if when we put our claim in through chargeback what we can claim for, will we get a full refund of the flight costs or half as we got one way travel, will we be able to claim for the loss of the train & hotel costs as they are now of no use to us.

I suspect you have booked accommodation with a third party and a flight with Globespan both though on the Beach? Is this true? What method of payment did you use. How much do you have to pay for the remainder of the holiday, and is the payment to do with the accommodation or flight?

Sorry more questions than answers, such is the complexitity.

How did you pay for the accommodation? If it was credit card then you should be able to claim back the flight and accommodation via your credit card company. If you took out travel insurance also check to see if you are able to claim through them if you havent used a credit card.

If you have paid for your flight and train, hotel with visa debit card then you should be able to get this refunded through the chargeback. Remember that many staff within banks are not familiar with the chargeback scheme so if they say that you are not entitled to claim, make sure you speak to a supervisor or manager.

I am a consumer like you, so I cannot really advise you on what to claim for, but why should you be out of pocket so make sure you claim for any service that you have paid on your visa debit card that you are now unable to use.

I booked my flight and accomodation through a different company Sunshine holidays for the accomodation who have been more than helpful even offering a full refund! And Ot Beach for my flights. Yes thats how i booked it paid master card credit card paid for both at same time the full amount 554 for flight and 297 for accomidation I think i might be ok with flight monies from credit card but not sure who will refund hotel payment thanks for everyones advice doug.

Hi Darren I booked a package holiday flights accomadation transfer I received confirmation email I had booked sept next year I paid deposit at the time with an A&L visa debit card 2 weeks later I paid another £100 with my visa debit card.

My email confirmation says I am atol protected and I was charged £5 for atol do you think I should try to get my money back through A&L or through ATOL absolutely gutted lost a great holiday but I feel so sorry for others so much worse off than me also the only globespan proof is my email as they dont send any paperwork will atol accept a print out as proof

Hi, i booked through Lowcost holidays and they put my holiday together…Fly globespan flight and independent hotel and their insurance. I got the standard email on the 16th an I immediatly emailed them to say if im not atol protected, either obtain this or cancel the holiday…..

No reply! i find it odd that when you read their website it states the offer ATOL as a reason to book with them also on the flight schedule supplied by them the ATOL stamp is applied…..

They say this is just office stationary and that without the ATOL number im not covered….this seems underhanded as i assumed by seeing this along with the ABTA stamp im covered…..

Im not a travel agent and trusted them…….now i cant speak to them all i get is a recorded message saying they will be in touch….I did get an email saying almost TOUGH LUCK!!!!!!

I payed using Debit visa and im going down this route now but how do these companies get away with this i feel i was missold this holiday and as they have joined hotel, flight., Insurance and transfers is that not a package…I think it is……COME ON LOWCOST PLAY FAIR.

I will try and get someone from lowcost holidays to come on and leave a comment about your situation. I agree that if it says that the company is ATOL protected then they should ENSURE that they tell you that they are booking you a holiday that is NOT protected through ATOL.

The whole holiday protection is a complete mess.

Thankfully you have paid with a Visa debit card so you should get your money back via the chargeback scheme, make sure you contact the bank ASAP.

I contacted VISA for advice on the chargeback scheme although HBOS are pursuing my money via a non fraudulent claim as the chargeback would be them paying me as i believe they were Globespans bank. I paid for flights using Visa Electron

Luckily I’ve paid my Globespan tickets, to fly out on my holidays, with my credit card, so I will get that money back but unfortunately I booked my return flight with Easy Jet, since Globespan didn’t fly on the day I needed to come back.
Since I haven’t been able to find an alternative flight out at an acceptable rate and time we had to scrap our holidays. That means that I am unable to use my return flight with Easy Jet.

What are the chances that I can convince my travel insurance to get those costs refunded.

Stand firm with your bank regarding chargeback. I appeared on Wokring lunch and they then contacted my bank HBOS and they confirmed that i was covered, even thought their droones at the call centre kept repeating the same thing. Should have used credit card…. typical bank trying to squirm out of paying.

I have removed the email as it does not help people reading this post. If you have paid for your holiday with Visa debit card then you should be able to claim chargeback on this. Keep on to your bank HBOS because they do have to refund you the money under visa’s chargeback scheme.

@ Joyce

I agree that people have to stand firm with their bank. I have read stories of people getting a cold response from their bank and its only when they have raised this with the bank branch manager or supervisor that they have received a claim to put in their chargeback.

@ Robert

It is worth a try. Have a word with your insurance company and see what they say. It might also be worth having a word with Easyjet but I doubt that you’ll be able to get the cost refunded from them. If you have paid with your credit card and cannot take the flight from the collapse would your credit card protection not cover this? Might be worth contacting the credit card company too. Keep on at them.

Hi , I booked flights to majorca three weeks ago .I paid using my maestro card , I have contacted the bank & travel insurance company & im not covered . I have read about the chargeback . Do you know if the royal bank does this ? Am i entitled to this ??

Unfortunatly, the Maestro card does not cover you for the chargeback scheme. This is for people that have used a Visa debitcard.

Your only other option is to make a claim with the administrators. The information is on the FlyGlobespan website.

Hi, I don’t want to give you mis-advice, but what I would do:

Contact the helpline telephone number on the FlyGlobespan website and ask for their advice. If you cannot get through, I would write a letter explaining the situation and the amounts you have paid for your flight. Take a photocopy of any invoices, flight information, passenger details, check-in printouts, anything you can give them to help your claim. The more information you can give them about your booking the better.

Take a photocopy of all of the paperwork and keep the original paperwork, just send copies. Send it to the address on the FlyGlobespan website, make sure you send it recorded delivery and keep a copy of that documentation too. Remember that a lot of people have been affected and this will take time, so be patient. I am not suggesting that you will get your money back, it’ll depend on who is owned money, like any administration.

I am so glad I have come across this webite – very informative. I have trawled through all comments and can’t quite get the answer of the booking of our flights with FGS. We paid for the flights online with Halifax Visa Electron. Does Visa Chargeback apply to this card too? If so, I can fight my corner with the bank!!!

Hi all, I got a phone call from Lowcost Holidays, to say that it was indeed tough luck and that they were in no way responsible for my holiday flights with F.G.S. but would return the cost of accomadation transfers etc…….Then asked me if i wanted to book another holiday with them…..Erm NO!!!! i still find it hard to believe their attitude they took my money they booked the flights and accomadation as well as transfers etc….I never even knew whow i was flying with until two days before the collapse but as for ATOL yes they are protected but the customer is not i feel they need to address the website as anyone can be misled into thinking as a customer you are ATOL and ABTA protected…….their get out clause is held within the reams of small print. To say im dissapointed is an understatement ……….

Here’s a new one, went to Florida in September and booked it all through Globespan (flights, rental car, accomodation) Paid for it with an HBOS credit card. Just received a letter today from Contempo Villas that they haven’t been paid and will be taking $580 from my credit card. I signed the rental agreement with Contempo, as you do, where the small print had something about making full payment if the company failed to pay! So here I am trying to figure this out, HBOS say it’s nothing to do with them, ATOL don’t have a form for this one, any ideas!

That is a difficult one for me to answer. If it is in the small print then I am not sure where you stand. This is horrible because you will be paying twice for the accommodation, which is not acceptable. Does it say on your invoices anything to do with ATOL protection? Have you tried contacting ATOL claim line for assistance? Feel free to drop me an email (via the contact form) with as much information as you can provide and I will try and see if anyone can advise.

Hi all , have since contacted the royal bank about chargeback , the maestro card is classed as a debit card but not a visa debit card , maestro is also part of master card hhhmmmm , anyway have asked about chargeback and i have to go into my branch & fill out a form , will take along my online reciepts from flyglobe .Also noticed flyglobe updated their website 24th dec , I see there are a couple of claims forms , cant hurt to fill out these either . I will try anything to get back something of my £1800quid for my flights ..

It is only worth completing an ATOL claim if your holiday was ATOL protected. If you are not sure then you might be best contacting their claimline. The form is quite long winded and you’ll only waste your time and also slow down the process for people who are ATOL protected. The Maestro card is a debit card and means your not protected but, some banks have been known to refund the money, so, it’s worth contacting them. Visa Debit card and the chargeback scheme is different.

We stayed in a Contempo villa in Florida in September as well and have also just received a charge on credit card. However, we luckily still have our contract and have noticed that we actually failed to sign the part regarding ‘Full Rental Payment for the Property should the travel Agent fail to make payment”. Where do we stand?

Hi Darren, I’ve been reading the article and comments and there has been a lot of useful information.

Could you give me your advice on the following please? I booked flights with Flyglobespan for £900 and paid using my RBS debit card (not Visa debit) in November. A few days before they went into administration I phoned Flyglobespan and asked for advice. The advised me to pay the amount again using my credit card so I would have protection and they would then refund me the debit card payment. I did this (in hindsight maybe not a good idea) but the refund was never processed before they went into administration. I was wondering if the credit card company would now be liable for the debit card amount as I believe that the credit card company is responsible for all amounts even if only a small amount was paid on the credit card. I’ve completed the form and am waiting to hear from them.

I’ve spoken to my branch and they said I was not covered by them for the debit card payment so I have also completed a claim form and submitted to the administrator but just wondered what you thought of my situation.

Hey Darren,

You’re my only hope now!

When I found out Globespan had gone into administration the first thing i did was e-mail otbeach.com and they basically sent me an emailing confirming things and saying that they would be in touch before the 15th of Jan now everytime i’ve answered my phone to them they hang up and i call them back and the call handler says that they will call me back! Its becoming totally tiring.

I’ve sent them several emails and i got one back the other day saying that the “team were finding it hard to find me flights that were an exact match” and that i should “go ahead and book flights if i see them and they may refund me some monies as a gesture of goodwill” A gesture of good will? There having a total laugh im actually raging!!!! Do they not realise if they can’t find a match am i just magically going to come across one?

Were a family of five and all very young so can’t afford to spend any more money were ment to fly out to Hurghada from Glasgow in March and our accomodation was booked with otbeach too. I Paid with my VISA DEBIT CARD. Please can you let me know if i’m entitled to any sort of refund and what my rights are?

Like David we also booked through Lowcostholidays thinking we had booked a package hol. to Lanzarote flying out on Dec.27 Although our holiday confirmation contained an Atol receipt, We also received the Email saying we were not covered by Atol on the 16th (strange?) We have since contacted Mastercard who say that because Lowcosthols has’nt gone under then we are not covered by them.

We then filled out the Europ-assistance insurance claim form. who said that all claims must be claimed through Atol firstly then when they receive confirmation in writing that they will not be covering our costs they will then refund any money due to us. After being messed around for so long, phoning and e mailing every day I do hope this will be an end to it all.

I recieved a call from otbeach.com yesterday they refunded our £1202 for our flights the guy on the other end of the phone was lovely and only doing his job but as otbeach have booked our accomodation seperatly he said that I would need to email refunds which i’ve done and said that i will recieve 100% of the holiday back but then said there may be a cancellation fee? surely this isn’t right when this situation is outwith our control???? We would love to go to Hurghada but with other Airlines this is expensive. The accomodation totalled £861 and they still have our card fee of £22.70.

Could you give us any further advice? I hope they don’t charge a cancellation fee as we still want to book a holiday through otbeach.

I suspect that in the booking terms and conditions there will be a section on cancellations, and it should mention the cancellation fee. If it doesn’t question this with them. It does seem unfair that you are charged this fee, but remember that the accommodation will be booked through a third-party, so there’s a chance that the accommodation provider charges them a fee too.

My advice in future would be to book with an ATOL bonded travel agency. This will mean you will not lose any money and receive the flight AND accommodation refunded in full.

Update on ATOL claim. Sent CAA claim form 19/12/09, received a letter from Huntswood CAA Team ( agents of ATOL crisis management ) dated 21/01/10 acknowledging claim with a reference number. They say their aim is to assess our claim within the next 4 to 6 weeks. Hope this is settled by mid March or sooner.

Finally received money back from Lowcost Holidays insurers Europ-assistance insurance minus £100 excess. So my message to David Young is don’t give up. We sent them proof that Atol and Mastercard were not going to pay us and with much persistance, calling and E-mailing very day they have finally paid out.

Still chasing my chargeback from The Royal Bank of Scotland. Phoned them this morning and their lastest is that they are still waiting on answers as E-clear has went into administration there is no one to claim the money back from .How come The bank of scotland and various other banks dont have a problem with this and are now re funding the money. Any ideas ?

Hi….Booked flights and hotels through (On The Beach). Flyglobespan flight and olympic holiday hotels, was due to fly out on the 26th Dec. 2009. Had to re-book flights through olympic holidays as they were the cheapest at time. had a great holiday but then had to come home and fight to get refund on original flights.

Booked through B.O.S visa debit card total cost of flights £1254 and after 6 weeks of phone calls letters and e-mails i recieved a letter saying B.O.S will not be paying out please see (On The Beach) for refund.
I am now in the proccess of official complaint through finacial ombusman, will let everyone know how i get on, I think i have given B.O.S a fair chance to follow the chargeback rules now i am seeking the help from the ombusman.

We are in the same boat as Alex Paterson regarding Contempo villas. We were on holiday in september you had to fill in the registration form or risked being put out of the property. I contacted my credit card company and they are not intrested and contempo wont answer any of my e-mails. I now have a letter from PricewaterhouseCoopers stating they have sought advice from the cival avation authority and the ATOL procection does not cover customers of the company once their holiday is complete. We dont know what to try next to get the $812 BACK

hi, Im happy to say that Capital One refunded my credit card with no fuss, I completed the forms and sent them back (quoting Section 75 rights) just prior to Xmas and the credit was on my credit card account approx 3 weeks later.

Bye Bye to my £1700 that i saved up for months for my first holiday in 7 years !!

In reply post regarding paying with visa debit. I received full refund from HBOS, only after i appearded on BBC2 Working Lunch high lighting the banks stance that they didn’t know anything about refunding debit card payments. Typical banks waiting until it is forced into action.

HI Darren, been reading through comments and the ones wrote by N. Ali on the 14th Jan 2010 and 19th Jan 2010 relates to the same situation i,m in. Booked a holiday with on the beach and paid the same way,could you please ask N.ALI how they managed to get a refund as i,ve been in dispute with them for seven month now and am getting nowhere. I can,t understand how on the beach can refund some people as a goodwill gesture and not others. I am in the process in taking them to a small claims court to try and get my £1638.00 back. Hope you can give me some help and advice.Paul B
